Subscription Agreement

Welcome to the DRIVYN Subscription Agreement. This agreement outlines the terms and conditions for your participation in the DRIVYN rental subscription program (“Services”). By confirming your subscription, you agree to the terms set forth below, which work in conjunction with the DRIVYN Terms of Use and Privacy Policy.

1. Waitlist & Pre-Onboarding

1.1. Customers may join the DRIVYN waitlist for vehicle rental. Once selected from the waitlist, you will receive a Pre-Onboarding Form to complete.

1.2. Customers choosing personal insurance or approved third-party insurance will: Select their start date and rental duration. See the total amount due for the rental. Receive an Onboarding Form via email within 24 hours containing full instructions and required document list.

1.3. Document Submission Deadline: You must upload all required documents, including proof of insurance, within 48 hours of receiving the Onboarding Form. Failure to do so will result in cancellation of your rental and a refund of 75% of your payment (25% retained for administrative costs and lost rental availability).

2. Insurance Options

You must select one of the following insurance options:

Personal Insurance – Provide valid proof of active coverage for rental period.

Third-Party Insurance – Purchase from an DRIVYN approved provider.

DRIVYN Company Insurance – Payment is not collected until verification and approval. Upon approval, you will receive a personalized one-time payment link for both rental and insurance.

3. Payments & Renewals

3.1. Weekly Recurring Billing: Rentals are billed weekly in advance. Your payment for the upcoming week will be processed before the start date of that week.

3.2. Rental Term Selection: At onboarding, you will choose the total number of weeks for your rental.

3.3. Extension Process: 36 hours before your end date, you will receive an Extension Form link via email. You must complete the form within 24 hours. Failure to complete the form will be taken as confirmation that you are not extending and will return the vehicle on the agreed end date, time, and location. Failure to return the vehicle on time without extension approval will result in additional charges and/or legal action.

4. Cancellations & Refunds

4.1. Customer Cancellation Before Start Date: If you cancel before your rental start date, 75% of your payment will be refunded, and 25% retained for administrative costs.

4.2. Mid-Term Cancellations and Billing: Your rental subscription is billed weekly in advance, for the upcoming week. You may cancel your subscription at any time to avoid being charged for future weeks. Once cancelled, you will not be billed for any subsequent weeks.

However, payments already made for the current week are non-refundable, regardless of early return or cancellation.

Late Cancellation Penalty: If you cancel more than 24 hours before your next weekly billing date, you will not be charged for the upcoming week. If you cancel within 24 hours of the next weekly billing date, a 25% administrative fee of the upcoming week’s payment will be charged, and you are still responsible for returning the vehicle as scheduled.

4.3. No-Shows Without Communication: If you fail to appear on the pick-up date and time without notice, you forfeit 100% of the payment for that week’s rental.

4.4. Onboarding Failure (Documentation Not Provided in 48 Hours): If you do not submit the Onboarding Form and all required documents (including proof of insurance) within 48 hours of receipt, your booking will be canceled, and you will be refunded 75%, with 25% retained for administrative and lost rental costs.

4.5. Company-Initiated Cancellations for Breach: If DRIVYN cancels your rental for breach of these terms, the applicable refund policy from 4.1 – 4.4 will apply.

5. Vehicle Use & Restrictions

You agree to comply with the DRIVYN Acceptable Use Policy which includes but is not limited to:

No use under the influence of drugs or alcohol.

No illegal use, racing, towing, or subleasing.

No operation by unauthorized drivers.

Returning the vehicle in the same condition, except for normal wear and tear.

6. Communication Consent

By entering into this Agreement, you consent to DRIVYN contacting you via SMS, MMS, phone calls, and email for service notifications, rental updates, extensions, billing reminders, and promotions. Messaging will comply with applicable APC and 10DLC regulations. Standard messaging rates may apply.

7. Governing Law

This Agreement is governed by the laws of the State of Illinois, United States, without regard to conflict of law principles.
